AWC Statute
Definitions.
- Terms of Use – this document sets down the rules governing use of the Service.
- Service – website at the domain awcsports.com
- Service – service delivered by the Administrator to the User through electronic means and governed by the Terms of Use.
- User – a person using the Service as delivered buy the Service Provider.
- Registration – process through which Access Data is provided so as to create an Account.
- Access Data – email address, password, first name and surname provided in the Registration process.
- Account – a Service web page to which access is limited by means of the Access Data, where the User may view and edit the data which they have entered into the Service.
- License – access to Digital Content granted to the User.
- Digital Content – materials made available through the Service in a digital form.
- Purchase Process – the process by which a User accesses paid Digital Content through a Payment Provider’s service
- Payment Provider – an external business offering payment services by means of its own system

General provisions
- All rights in the Service and its constituent elements are the property of the Service Provider.
- Service Provider will make every effort to enable Users to use the Service by means of internet browsers, operating systems, devices and internet connections described in Paragraph 6 : Technical requirements. Adhering to these requirements is the User’s own responsibility and not the Service Provider’s.
- In order to enable the provision of the Service, the Service Provider places “cookies” as well as “localStorage” and “sessionStorage” files on the hard drive of the device used to access the Service. These files are necessary for the transmission to work. They do not change the uration of the device on which they are placed, nor do they in any way alter any applications installed on it. User may block these files at any time but this may negatively affect the Service or may entirely disable provision of the Service. Service Provider will not be in any way responsible for such effect or disablement.
- In order to be able to create an Account, User needs to have an active email account.
- User may not make available on the Service and content that is illegal or causes harm to third persons whether by intent or not.
- User is forbidden from using the Service or the Digital Content made available by the Service Provider in any way that is contrary to the Terms of Use or that is illegal, causes harm to third persons or the interests of the Service Provider.
- Service Provider reserves the right to suspend or close the User’s Account should it find the User in contravention of the Terms of Service or applicable laws. It may also and at its discretion, make the User’s Access Data available to the authorities.
- User may access the Service exclusively for his or her own use. The Service may not be used in any way the harms the interests of the Service Provider.
- Service Provider will not be responsible for any changes to the Digital Content made available on the Service where such changes are beyond its control
Registration
- User must register in order to create an Account.
- To register, User must complete the registration form on the page “Login” in the tab “Registration”. User must correctly fill in all required information and acknowledge and consent to the Terms of Use by marking appropriate fields. User must provide true and factual information.
- On successful registration, User will receive confirmation, sent to the email address given on registration. This constitutes an agreement between the User and the Service Provider, for the Account to be established electronically and for Service to be provided. At this point, User receives full access to the Service.
- Service Provider will not be held responsible for any problems in delivery of electronic mail arising out of errors on the part of the operator of the User’s email account.
Access to the Service
There may be interruptions to the Service, caused by scheduled maintenance or other reasons necessitating temporary suspension while there is no Digital Content being made available.
Components of the Service:
- Application form
- Contact form.
- Maintenance of the User Account following Registration.
- Access to available Digital Content.
- Making Digital Content available once User has been granted access.
Terms of suspension of Service:
- Should User contravene the Terms of Use, behave unlawfully, cause harm to third persons or to the interests of the Service Provider, the Service Provider may at its discretion suspend or terminate the User’s Account, and block any Services delivered by electronic means. Such blocking of services may also be done for reasons of security, when it is required by law or at the request of authorities.
- User will be informed that the Account has been, or may be suspended or terminated by means of email. Service Provider will not be held responsible for any actions or omissions arising out of the User failing to be informed due to any errors or malfunctions on the part of the User’s email account.
Availability of Digital Contents
- Information on Digital Content provided on the website of the Service constitutes the offer to enter into a contract for the provision of Digital Content by the Service Provider. Paid access to Digital Content is possible after the User pays the fee in the Purchase Process.
- User may access the Digital Contents only while the Service is functioning fully. The Service may be limited by the Service Provider during maintenance periods or once the Digital Contents offer has expired.
- By completing the Purchase Process, the User approves the Service Provider’s offer regarding the selected Digital Content.
- Access to paid Digital Content is provided once the receipt by the Service Provider of the User’s payment. The Service Provider reserves the right to extend the approval process and provide access to Digital Content in the event of a faulty or slow operation of the Payment Operator selected by the User.
- The User makes payments by payment card or bank transfer via an external payment system operated by the Payment Operator of his choice.
- The user makes an SMS (text message) payment by sending a message to a special number. Information about the cost and detailed instructions are available in the payment view.
- The Service Provider reserves the right to limit the choice of the Payment Operator.
Technical requirements
- Full access to the Service as part of the Website is possible on devices with access to the Internet with a minimum bandwidth of 10 Mbps.
- The service is not available for operating systems running on the same hardware and system platform using a virtual machine.

Complaints
- The User has the right to lodge complaints related to malfunction of the Service.
- The Service Provider recommends filing complaints within 14 days of the end of the delivery of Digital Content.
- The complaint may be submitted using the application form.
- The Service Provider shall consider the complaint within 14 days and notify User of its decision via the notification system that is part of the Service and / or electronically via a message sent to the email address assigned to the User’s Account.
- There is no possibility of a complaint arising from dissatisfaction with the content of Digital Content provided by the Service Provider.
Termination of Service
- The User has the right to withdraw from the contract for the provision of the Service within 14 days from the date of the contract – in the case of paid Digital Content, provided that he has not started using the Service. The desire to withdraw from the contract should be communicated through the application form available in the User’s Account view.
- The Service Provider is obliged to return the payment made to the User within 14 days of receiving the User’s notification of withdrawal from the contract.
- The return is made through the same manner in which the fee was paid or in the event of a request by the User by the method chosen by the User.
Personal data
- The Administrator of User’s personal data voluntarily provided to the Service Provider is the Service Provider.
- The processing of Users’ personal data is done in order for the Service Provider to provide services electronically and for other purposes set out in the Terms of Use. Processing of the data takes place only within the scope of the law or the User’s consent.
- User has the right to inspect and correct their personal data.
- The User has the right to have their personal data removed from the Service database, except for when the User has violated the law or the Service Terms of Use and these data is required to determine the User’s responsibility.
- The Service Provider’s data provided is protected by the Service Provider against unauthorised access by third parties.
- The Service Provider may provide the necessary data to the Payment Operator as part of the Purchase Process, to enable the User to obtain paid access to Digital Content.
Termination of service
- Termination of the contract for the provision of electronic services can be made by submitting a declaration of intent using any such means of communication as will enable the other party to become acquainted with it.
Actions inconsistent with and contrary to the Terms of Use
- User is forbidden from sharing Digital Content produced by the Service Provider or entities cooperating with the Service Provider without the Service Provider’s prior written consent. The Service Provider declares that in the case of unauthorised sharing of Digital Content, it will take all available steps to protect its rights by notifying law enforcement authorities about the possibility of a crime having been committed and will begin the process of claiming compensation under applicable law.
- User is prohibited from interfering in the operation and appearance of the Service and change its functionality in any way.
- User is prohibited from connecting to the Service using a VPN or otherwise hiding the User’s location / IP address.
- The Service Provider has the right to block access to Digital Content in the event of non-compliance and use contrary to the Terms of Use.
- The User does not have the right to request a refund in the event of access having been blocked for any of the reasons given above.
Final provisions and amendment to the Terms of Use
- The basis for all disputes arising under the Terms of Use is the law of the republic of Poland.
- The Service Provider reserves the right to amend the Terms of Use at any time.
- All contracts executed before the entry into force of any Terms of Use are implemented on the basis of the Terms of Use that were in force on the day of the execution of the contract.
- The amendment to the Terms of Use shall enter into force within 7 days of publication of such terms on the website of the Service.
- In the event that the User disagrees with any such change to the Terms of Use, he or she should notify the Service Provider, which will result in termination of the contract.
